L’11 febbraio, infatti, il Dipartimento delle Politiche abitative e dello Sviluppo urbano degli Stati Uniti d’America ha stabilito che i divieti antidiscriminatori dei Titoli VIII-IX del Civil Rights Act del 1968 (più conosciuti col nome di Fair Housing Act) saranno d’ora in poi estesi anche all’orientamento sessuale e all’identità di genere. Come noto, essi proibiscono la discriminazione nell’acquisto, affitto o richiesta di finanziamento per l’acquisto di un alloggio sulla base di razza, colore, religione, origine nazionale e sesso.
Per una tale interpretazione estensiva il Dipartimento ha fatto riferimento a quanto disposto dalla decisione Bostock v. Clayton County (15 giugno 2020), con cui la Corte Suprema ha stabilito che il divieto di discriminazione lavorativa del Titolo VII del Civil Rights Act del 1964 «sulla base del sesso» è da estendersi anche all’«orientamento sessuale e identità di genere».
A tal riguardo l’Office of Fair Housing and Equal Opportunity (Fheo) del Dipartimento ha diffuso un memorandum per l’applicazione di tale normativa, che è una diretta conseguenza dell’Ordine esecutivo del presidente Biden «sulla prevenzione e la lotta alla discriminazione sulla base dell’identità di genere o dell’orientamento sessuale».
Come rilevato dal Dipartimento, una serie di studi sulla discriminazione abitativa ha infatti dimostrato indubitabilmente che le coppie dello stesso sesso e le persone transgender statunitensi subiscono un trattamento meno favorevole rispetto alle loro controparti eterosessuali e cisgender quando cercano un alloggio in affitto.
