Officer who arrested Michael loses slander suit
LOS ANGELES, Feb 16 (Reuters) - A court has dismissed a bid by the undercover Los Angeles policeman who arrested George Michael in a public lavatory in 1998 to sue the British pop star for $10 million on the grounds of emotional distress.
Marcelo Rodriguez went to court last September over an
irreverent pop video "Outside" released by Michael shortly
after the April 1998 arrest for lewd behaviour.
The video, shot partly in a lavatory and mocking the gay singer's arrest in a Beverly Hills park, featured men dancing in tight black leather uniforms and scenes of two policemen kissing.
Rodriguez claimed emotional and mental distress and
slander, saying Michael had profited at his expense through the pop video and in subsequent interviews claiming he had been set up by what appeared to be a good looking gay man.
A Los Angeles Superior Court judge dismissed the case on Monday, saying Rodriguez was a public official and could not under law recover damages for alleged emotional distress. The court papers were made available on Wednesday.
The popularity of the British singer has soared since the humiliating arrest prompted him to acknowledge his
homosexuality. Michael said last September the Rodriguez lawsuit was "a classic case of American law at its craziest." Michael, who has a home in Los Angeles, pleaded no contest to the lewd behaviour charge and was fined $800 and ordered to do community service.
Lawyers for Michael or Rodriguez could not be reached for comment on the case.
